Universal Terms of Service & Privacy Policy

Section 1: Account Creation, Membership, and Scope of Use

1.1 Universal Binding Agreement: By creating an account, accessing the TFP platform, or purchasing any subscription, you enter into a legally binding contract with The Final Percent. These terms apply to all tiers of membership, from general account holders to high-level mastermind participants.

1.2 One-User, One-Account Policy: Membership is granted to a single individual. You are strictly prohibited from sharing login credentials, "account splitting," or allowing unauthorized third parties to access the platform via your account. Any detection of multiple concurrent logins from different geographic locations may result in immediate account suspension for security review.

1.3 Eligibility and Gender-Specific Access: While TFP is a global ecosystem, certain "Isolated Groups" have specific eligibility requirements. By using the platform, you agree to respect the gender-specific boundaries of the Kappa Club (strictly women) and the Gamma Group (strictly men). Attempting to bypass these restrictions or misrepresenting your identity to gain access to these groups is a violation of these terms.

1.4 Modification of Services: TFP reserves the right to update, modify, or discontinue specific mastermind groups, features, or regional chapters (e.g., Infinite Launch, Infinite Serve) to maintain the quality of the community. Members will be notified of significant changes via the email associated with their account.

Section 2: Conduct, Confidentiality, and The "Social Contract"

2.1 Zero-Tolerance Gossip & Harassment Policy: TFP is a professional environment for growth. We maintain a zero-tolerance policy for gossip, slander, or degradation directed at other members, leaders, or external businesses. This includes "indirect gossip" (vague-posting or hinting at drama). We reserve the right to determine what constitutes "egregious behavior" and may terminate accounts immediately to protect the community.

2.2 Strict Confidentiality (The Vegas Rule): In a mastermind environment, vulnerability is required. Therefore, all information shared within any TFP group—including names, business strategies, personal struggles, and contact information—is considered Highly Confidential.

  • You may not screenshot, record, or transcribe group discussions.

  • You may not share a member’s "win" or "loss" outside the platform without their express written consent.

  • Breach of confidentiality is one of the most serious offense at TFP and will result in a permanent ban without the possibility of a refund.

2.3 Anti-Solicitation and "Consent-First" Business: While we encourage networking, TFP is not a marketplace for "cold" leads.

  • No General Advertising: You may not post generic sales pitches or advertisements in group forums.

  • Direct Solicitation: You must have a direct conversation and receive consent before pitching services to another member.

  • No Data Mining: Using the member directory to build email lists for external marketing is strictly prohibited.

Section 3: Financial Terms, IP, and Liability

3.1 Intellectual Property (IP) Rights: All content—including but not limited to videos, PDFs, "Gamandments," "Kappa Woman" standards, and proprietary analytics frameworks—is the sole property of The Final Percent. Your membership grants you a personal, non-transferable license to view the material. You may not download, redistribute, or use TFP materials for your own commercial training purposes.

3.2 Auto-Renewal and Payment Authorization: By purchasing a subscription, you authorize TFP to charge your provided payment method on a recurring basis (monthly or yearly).

  • Renewal Date: Charges occur on the same day each period.

  • Price Changes: TFP will provide at least 30 days' notice before any change in subscription pricing.

3.3 Cancellation and Access Revocation: You may cancel your subscription at any time through Settings > Purchase History > Cancel. Upon cancellation, your "Current Term" remains active until the next scheduled billing date. It is the member's responsibility to cancel prior to the renewal date to avoid the next charge.

3.4 Refund Policy and Commitment: TFP operates a No-Refund Policy. Once a member has accessed the digital "vault," logged into the app, or engaged with a representative, the service is considered "rendered."

  • Mischarge Exception: Duplicate or wrongful charges caused by system errors will be refunded 100%.

3.5 Grace Periods and Failed Payments: If a payment fails, TFP provides a courtesy grace period (7 days for monthly / 30 days for yearly). If payment is not secured by the end of the grace period, all group and content access will be automatically terminated.

Section 4: Governing Law and Dispute Resolution

4.1 Governing Law: These Terms and any disputes arising out of or related to them will be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles.

4.2 Mandatory Arbitration: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration rather than in a court of law.

4.3 Venue and Jurisdiction: The site of arbitration and the exclusive jurisdiction for any legal proceedings shall be Boulder County, Longmont, Colorado. You hereby waive any objection to this venue on the grounds of "inconvenient forum."

4.4 Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between TFP and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other or decided on a class-action basis.
