ONLINE RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

By checking the box above, you ("Participant") agree to the terms of this Release, Waiver of Liability, Assumption of Risk, and Indemnity Agreement (“Agreement”) with The Final Percent LLC. ("Organization"). Your participation in any activity, service, or event provided by The Final Percent LLC. is contingent upon your acceptance of this Agreement.

1. ACKNOWLEDGMENT OF RISK

By participating in activities offered by The Final Percent LLC., you acknowledge and understand that the activities involve inherent risks, including but not limited to:

Physical injury (e.g., falls, slips, collisions)
Emotional distress
Damage to property
Health risks such as exhaustion, dehydration, or overexertion
Environmental hazards, including terrain and weather conditions

You knowingly and voluntarily assume all risks associated with your participation.

2. WAIVER OF LIABILITY

By checking this box, you release and discharge The Final Percent LLC., its officers, employees, agents, contractors, and affiliates from any and all claims, damages, liabilities, and legal actions arising out of or related to your participation in the activities, including those caused by the negligence of The Final Percent LLC.

This waiver includes, but is not limited to:

Personal injury or death
Property damage
Any claims related to medical treatment or lack thereof.

3. INDEMNIFICATION

You agree to indemnify and hold The Final Percent LLC. harmless from any loss, liability, costs, or damages arising from your participation, including legal fees related to any claims brought by you or third parties as a result of your actions during participation.

4. CONSENT TO MEDICAL TREATMENT

In the event of an emergency, you authorize The Final Percent LLC. to obtain necessary medical treatment on your behalf. You agree to be financially responsible for any medical services received and release The Final Percent LLC. from any liability related to medical decisions.

5. PHOTO/VIDEO RELEASE

You grant The Final Percent LLC. the right to use any photos, videos, or media taken during your participation for promotional or commercial purposes. You waive any right to review or approve the final product and acknowledge that you will not receive compensation.

6. VOLUNTARY PARTICIPATION

You confirm that you are participating voluntarily, that you are at least 18 years old (or have parental consent if under 18), and that you understand the terms and risks involved.

7. SEVERABILITY

If any part of this Agreement is found to be invalid or unenforceable, the remaining terms will continue to be valid and enforceable.

8. GOVERNING LAW

This Agreement will be governed by the laws of Colorado The United States Of America.
